“PELAKSANAAN EKSEKUSI ASET HARTA KEKAYAAN BUMN PERSERO DALAM KEPAILITAN OLEH KURATOR” (STUDI KASUS KEPAILITAN PT. KERTAS LECES PERSERO)

Bankruptcy is a general seizure and execution of all debtor assets for the benefit of all its creditors. As is known until now there has not been a single BUMN in the form of a Persero that has succeeded in implementing the asset execution stage by the curator even though it has been declared bankrupt, referring to this the author took the bankruptcy case study of PT. Kertas Leces (Persero) in Probolinggo, East Java as the study object in this study. This research takes the formulation of the problem regarding how the execution of assets of the BUMN by the Curator and how the Curator's efforts in facing obstacles related to his duties in carrying out executions, especially in BUMN Persero. The purpose of this research is to find out the execution of the assets of the BUMN Persero by the Curator and how the Curator attempts to deal with these obstacles. This study uses a method using an empirical juridical approach. Juridical approach namely law is seen as the norm or das sollen. While the empirical approach is law as a social reality or das sein. So, the empirical juridical approach in this study means that in analyzing the problem carried out by integrating legal materials (which are secondary data) with the primary data obtained in the field, namely about the execution of assets in bankruptcy assets carried out by the curator. Based on this study found several obstacles in the execution of assets assets of PT. Kertas Leces Persero by the curator where constraints are classified both internally, such as the harmonization of existing and external regulations such as data collection on assets that require a long time. In conclusion, this study will describe the efforts of curators in facing obstacles in the execution of assets at PT. Kertas Leces Persero
